The Court of Appeal sitting in Abuja has upheld the Federal High Court judgment recognising AbdulGhani Arobo as the candidate of the All Progressives Congress (APC) for the Owo/Ose Federal Constituency of Ondo State.
The appellate court gave the decision while resolving five appeals filed by Hon. Oluwatimehin Emmanuel Adelegbe, Engr. Kayode Ijalana, Dr. Abiola Oshodi and the APC, challenging the judgment of the Federal High Court.
The appeals sought to overturn the lower court’s decision which recognised Arobo as the rightful APC candidate for the House of Representatives seat.
Arobo had dragged the APC and the Independent National Electoral Commission (INEC) before the court via a suit marked, FHC/ABJ/CS/26 over the party’s primary election held on May 16, 2026.
Justice Peter Lifu of the Federal High Court
in a judgment delivered on Wednesday, August 5, 2026, upheld Arobo’s victory in the party’s primary having scored the majority of the lawful votes cast in the said election.
Delivering judgment, the Court of Appeal resolved the issues raised in the various appeals in favour of Arobo, thereby affirming the decision of the trial court.
The verdict reinforces the Federal High Court’s judgment on the APC candidacy for the Owo/Ose Federal Constituency.
